Party Wall Surveyor Services

Party wall matters can quickly become contentious if not managed correctly. At James Scott Associates, we provide clear, professional and pragmatic Party Wall Surveying services to help protect all parties and keep projects moving.

We act strictly in accordance with the Party Wall etc. Act 1996, offering impartial advice and practical solutions to minimise risk, reduce conflict and ensure statutory compliance.

We are regularly appointed as Building Owner’s Surveyor, Adjoining Owner’s Surveyor, or as Agreed Surveyor, depending on the circumstances of the project and the wishes of the parties involved.

Building Owner’s Surveyor

When acting for the Building Owner, our role is to help you comply fully with the Party Wall etc. Act 1996 while enabling your project to proceed with confidence.

Our services include:

  • Advising on whether the Act applies

  • Preparing and serving valid Party Wall Notices

  • Liaising with adjoining owners and their surveyors

  • Preparing Party Wall Awards

  • Recording schedules of condition

  • Advising on access, construction methods and risk mitigation

We take a proactive approach to help avoid unnecessary disputes, delays or escalation, while ensuring your legal obligations are met.

Adjoining Owner’s Surveyor

When appointed by the Adjoining Owner, our priority is to protect your property and ensure that proposed works are carried out in a manner that minimises risk and disturbance.

Our role includes:

  • Reviewing proposed works and construction details

  • Assessing potential risk to the adjoining property

  • Preparing or reviewing schedules of condition

  • Negotiating protective measures and safeguards

  • Agreeing fair and reasonable Party Wall Awards

We provide clear, independent advice, ensuring your interests are properly represented throughout the process.

Agreed Surveyor

In appropriate circumstances, we can act as Agreed Surveyor, appointed jointly by both the Building Owner and Adjoining Owner.

Acting as an Agreed Surveyor can:

  • Reduce costs

  • Streamline the process

  • Encourage a cooperative, less adversarial approach

When acting in this role, we remain entirely impartial, ensuring the requirements of the Act are met while balancing the interests of both parties fairly and professionally.

Do I Need a Party Wall Surveyor?

You may need a Party Wall Surveyor if you are planning building works that fall under the Party Wall etc. Act 1996. The Act is designed to protect both you and your neighbour by setting out a clear legal process before certain works begin.

Common examples of works that are covered include:

  • Building on or up to the boundary line

  • Works directly to a shared or party wall

  • Loft conversions involving party walls

  • Excavations close to a neighbouring property

  • Basement or foundation works within prescribed distances

If your proposed works affect a shared structure or are close to a neighbouring property, you are likely required to serve a Party Wall Notice before starting.

What Happens After a Party Wall Notice Is Served?

Once a notice has been served, the adjoining owner can:

  • Consent to the works

  • Dissent and appoint their own surveyor

  • Agree to the appointment of a single Agreed Surveyor

If there is a dissent, a Party Wall Surveyor (or surveyors) must be appointed to prepare a Party Wall Award, which sets out how and when the works can be carried out, along with safeguards to protect the adjoining property.

Why Appoint a Party Wall Surveyor?

A Party Wall Surveyor helps to:

  • Ensure legal compliance with the Act

  • Protect both parties’ properties

  • Reduce the risk of damage-related disputes

  • Provide clear procedures if issues arise

  • Keep projects moving without unnecessary delay

Failing to follow the correct process can lead to delays, disputes, injunctions or claims, even where works are well intentioned.

At James Scott Associates, we provide straightforward guidance on whether the Act applies, what notices are required, and the most appropriate route forward – whether acting for the Building Owner, Adjoining Owner or as Agreed Surveyor.

Party Wall FAQs

What is the Party Wall etc. Act 1996?

The Party Wall etc. Act 1996 is legislation that provides a legal framework for carrying out certain building works that affect shared walls, boundaries or neighbouring structures. Its purpose is to protect both the Building Owner carrying out the works and the Adjoining Owner whose property may be affected.

Common works that require notice include:

  • Building on or up to a boundary line
  • Works to a shared or party wall
  • Loft conversions involving party walls
  • Excavations within prescribed distances of a neighbouring property
  • Basement or foundation works

If in doubt, professional advice should always be sought before starting work.

Notices must usually be served:

  • At least two months before works to a party wall or boundary wall
  • At least one month before certain excavation works
  • Starting work without serving the correct notice can lead to delays, disputes or legal action.

If the adjoining owner provides written consent, the works may proceed without a Party Wall Award. However, it is often still advisable to record a Schedule of Condition to protect both parties should any damage be alleged later.

If the adjoining owner dissents, surveyors must be appointed to resolve the matter. This can be:

  • One surveyor for each party, or
  • A single Agreed Surveyor acting impartially for both parties
  • The surveyor(s) will prepare a Party Wall Award setting out how the works may proceed.

In most cases, the Building Owner carrying out the works is responsible for the reasonable costs of the Party Wall Surveyor(s), including preparation of the Party Wall Award and Schedule of Condition.

Timescales vary depending on the type of works, neighbour responses and complexity. Straightforward matters can often be resolved within a few weeks, while more complex cases may take longer.

Early instruction helps keep the process efficient.

Yes. Where both parties agree, a single Agreed Surveyor can be appointed. This can reduce costs and simplify the process, provided the matter is suitable and both parties are comfortable with this approach.

If damage occurs as a result of the works, the Party Wall Award will usually set out procedures for making good or compensating the adjoining owner.

Even where relationships are good, the Party Wall process provides legal protection for both parties. Many disputes arise not from the works themselves, but from misunderstandings or lack of clarity later.

We provide clear, practical advice at every stage of the Party Wall process, acting as Building Owner’s Surveyor, Adjoining Owner’s Surveyor or Agreed Surveyor.

If you are unsure whether the Act applies or what steps to take, early advice from James Scott Associates can help avoid unnecessary delay, cost or dispute.
